1. Services

Kerston's World of Painting provides interior painting, exterior painting, commercial painting, cabinet painting, wallpaper removal, and drywall repair services to residential and commercial customers throughout North Versailles, Pennsylvania and the surrounding Pittsburgh area.

All services are subject to availability, scheduling, and site conditions. We reserve the right to refuse or discontinue service at any time for reasons related to safety, legal compliance, or circumstances beyond our reasonable control. Service availability may vary based on location within our service area.

As a home improvement contractor operating in Pennsylvania, Kerston's World of Painting is registered with the Pennsylvania Office of Attorney General in accordance with the Home Improvement Consumer Protection Act (HICPA), 73 P.S. §§ 517.1 et seq. Our registration number is available upon request and will appear on all written contracts, estimates, and proposals as required by Pennsylvania law.

2. Estimates and Pricing

Any estimate or quote provided by Kerston's World of Painting is non-binding unless confirmed in a written, signed contract. Verbal estimates are provided for general guidance only and do not constitute a binding agreement.

Under Pennsylvania's Home Improvement Consumer Protection Act, the final price of a project performed under a written contract may not exceed the original contract price by more than 10% without a written change order signed by both parties. Any changes to the scope of work, materials, or specifications must be documented in writing and signed by the customer and our company before additional work is performed.

Final pricing may vary based on changes in scope, unforeseen site conditions, material availability, or other factors discovered during the project. We will communicate any anticipated changes to you before proceeding.

3. Payments

This website does not collect payments. All payments are handled directly between the customer and Kerston's World of Painting outside of this website. We accept Apple Pay, cash, check, credit card, PayPal, Venmo, and Zelle.

For residential home improvement contracts governed by Pennsylvania's HICPA, we may not demand or receive any payment before a written contract is signed. For contracts with a total price exceeding $5,000, deposits shall not exceed one-third of the total contract price, plus the cost of any special-order materials designated in the contract.

Unless otherwise agreed in writing, full payment is due upon satisfactory completion of the work. Failure to pay amounts owed may result in lawful collection actions, including but not limited to referral to a collections agency or legal proceedings.

4. Appointments, Access, and Right of Rescission

Customers are responsible for providing safe and reasonable access to the property and work areas. All pets, hazardous materials, and obstacles must be secured or removed from work areas prior to our crew's arrival. Failure to provide adequate access may result in rescheduling and could affect project timelines.

Right of Rescission: In accordance with Pennsylvania's Home Improvement Consumer Protection Act, residential customers have the right to rescind any home improvement contract within three (3) business days of signing without penalty. To exercise this right, written notice must be provided to Kerston's World of Painting within that period. Any deposits paid will be refunded in full upon timely rescission. This right does not apply to contracts executed under bona fide emergency conditions as defined under Pennsylvania law.

We do not currently have a standard cancellation window for scheduled appointments. If you need to cancel or reschedule, please contact us as soon as possible so we can accommodate other customers.

5. SMS Messaging Terms

By providing your phone number and consenting to receive SMS messages from Kerston's World of Painting, you agree to receive text messages related to your service inquiries, project updates, scheduling, and occasional marketing or promotional communications.

• SMS consent is not a condition of purchase. You may use our services without consenting to SMS communications.
• We send two types of messages: service-related messages (such as appointment reminders and project updates) and marketing or promotional messages (such as seasonal offers or service announcements).
• To opt out of SMS messages at any time, reply STOP to any message you receive from us.
• For help, reply HELP or contact us directly at (412) 853-9727.
• Message frequency varies based on your service activity and our promotional schedule.
• Message and data rates may apply depending on your mobile carrier and plan.
• Mobile carriers are not liable for delayed or undelivered messages.
• Your phone number and SMS consent are never sold, rented, or shared with third parties for marketing purposes.

We do not guarantee that project timelines will remain unchanged due to weather conditions, material availability, unforeseen site conditions, or other factors outside our reasonable control. Any timelines provided are estimates unless expressly stated otherwise in a written contract.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Kerston's World of Painting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or this website, even if we have been advised of the possibility of such damages.

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to weather events, material shortages, acts of God, labor disputes, or governmental actions.

Our total liability to any customer for any claim arising out of or related to services provided shall not exceed the total amount paid by that customer for the specific service giving rise to the claim.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Allegheny County, Pennsylvania.

These Terms are specifically subject to Pennsylvania's Home Improvement Consumer Protection Act (HICPA) and any other applicable Pennsylvania consumer protection statutes.

11. Changes to These Terms

Kerston's World of Painting reserves the right to update or modify these Terms and Conditions at any time without prior notice. Changes will be effective upon posting to this website. The "Last updated" date at the top of this page will reflect the most recent revision. Your continued use of our website or services after any changes are posted constitutes your acceptance of the revised Terms.
